We represent individuals in serious personal injury matters, motor vehicle accidents, and my favorite, beating up insurance companies. Today, I’d like to talk about what we would refer to as the standard of care for truck drivers. In my firm’s experience in dealing with truck driving accidents, we find that there are three areas that we’re most interested in when we’re dealing with our clients. First of all, we want to make sure that the equipment that’s being used by the truck driver is in proper working order. Under federal law most trucks and commercial vehicles are regulated and must have particular kinds of safety equipment, not only to protect the cargo and the driver, but other individuals who may be driving nearby. The second is that the driver himself or herself, must be properly trained. Under federal law, you must have a commercial driver’s license, which requires you to have completed a certain amount of schooling, and understand the rules of the road. Third, and most importantly, the driver of the truck or commercial vehicle must be driving appropriately for the circumstances. If they’re in snow or water, or any kind of inclement weather, they have to adjust their driving accordingly. What we see more than anything is individual drivers of commercial vehicles that are driving too fast to beat their deadlines.
