Today I’d like to address the issue of getting your car fixed after a car accident. I guess one of the benefits of being a lawyer is when you have your own legal issues, you can take care of yourself.
Legal Advice on Getting Your Car Fixed After a Car Accident
Recently, I decided to back my car into a pole, which is never a good idea. Especially because both of my in laws were in the back seat. Now, after going through that experience, I want to share a couple of things with you about getting your car repaired while the insurance company is evaluating the claim.
First of all, under virtually every insurance policy you’re entitled to have your rental car paid for while the car is being worked on. And the car they let you rent will be similar to the car that you’re driving, but most of the time they’ll put a cap on how much they will pay you. Even if it takes longer to get it repaired, like it did with mine.
The second thing, and I think probably the most important issue, is when your car is being repaired under an insurance policy. Especially if it’s under another’s insurance policy who caused the accident, it’s important to know that they are required to return your car to the condition it was in prior to the accident.
Now, that means they have to use like-kind and quality materials. And if they can’t return the car to its original condition, then they are obligated to pay you the market value of your car at the time of the accident. That can be very frustrating for people, especially if the car has been paid for and they have no interest in getting a new car payment. But there are a lot of options when that happens, but you’ve got to get into the details of that insurance policy.
Good luck.
